Employers face significant liability if an employee is improperly classified as an “independent contractor.” The State of Washington audits employers to determine if the employer has misclassified workers. A worker may be deemed an employee under a variety of tests, and different government entities use different tests. Factors include, when and where to do the work, what tools are used, and who provides them, whether the independent contractor makes services available to other companies.
